Tysons is a business district with a business district's exposures.

Tysons is Fairfax County's central business district, and the scale is easy to underestimate. It sits on about 1 percent of the county's land and holds roughly a quarter of its office space and an eighth of its retail. The daytime population runs past 100,000 against 26,374 residents at the 2020 census, so most of the people you are responsible for on a given day do not live here. The Tysons Community Alliance puts annual retail spending above $2.4 billion, with 68 percent of it coming from people who traveled more than 10 miles to get here.

That shape creates a specific set of exposures. Almost nobody here owns their building. You lease space in a multi-tenant tower, which means your insurance requirements were written into a lease you signed years ago rather than negotiated at your last renewal, and the landlord's certificate request is often the first time anyone checks whether the two still match. Four Silver Line stations feed foot traffic into the ground floors, which changes the general liability picture for anyone with public-facing space. And with office vacancy near 20 percent and roughly 5.6 million square feet empty, landlords are competing on tenant improvement allowances, so a lot of Tysons businesses are in the middle of a build-out right now.

Build-outs are where we find the most gaps. The contractor's certificate expires mid-project. The builders risk policy names the wrong insured. Nobody has confirmed whether the landlord needs to be additional insured on a primary and noncontributory basis, which is usually what the lease actually says. None of that surfaces until there is a claim or a renewal, and by then the leverage is gone.
